What We Do For Financial Institutions

Loan Documents

Our job is to make life easier for your loan officers, processors, and reviewers. We prepare loan documents for commercial real estate, commercial asset based, commercial construction, residential real estate, owner interim construction, home equity, spec house construction, real estate development, SBA (7a and 504), USDA B&I, and oil and gas loans, along with loan modifications and assumptions. We use software that allows us to develop and code our own forms. While we have loan document sets we have developed over the years (and continue to constantly refine), we can add any custom forms or language you require. We strive to turn around loan documents quickly. Rush jobs? Par for the course. There is never an up-charge for “rush jobs”. We charge fixed fees for all our loan documents (except for title review for oil & gas loans) so you and your borrowers don’t have any surprises at closing. Need loan documents redrawn to reflect changes in terms, dates, etc.? No problem, we do not charge re-draw fees. Borrower’s counsel requesting revisions to the loan documents? Negotiating and drafting revisions to the loan documents is part of our fixed fee. Finally, we never want our fee to cause a problem between you and your customer. We will always work with you on a fee. Our financial institutions practice group includes attorneys board certified by the Texas Board of Legal Specialization in commercial real estate law, farm and ranch real estate law, and oil, gas, and mineral law.

Loan Workouts, Foreclosures, and Debt Collections

Our job is to get your problem loans back on track if possible and if not, to efficiently proceed through foreclosure and collection. Whether it is a loan workout or modification, foreclosure, or collection after liquidation of collateral, we can help. Often a demand letter from us is all it takes to get a problem loan back on track. But, if necessary, we are prepared to take a problem loan through foreclosure (including home equity foreclosures and UCC collateral liquidations) and collection after foreclosure.

Have questions on loan structure, homestead, title problems, collateral, and the myriad other issues and problems that can affect a loan? We are here to answer your questions promptly. We can also assist you in your regulatory and day to day banking questions. We can help you with your corporate governance. We can review your corporate governing documents (articles and certificates of formation and bylaws) and update them as needed. We can assist you in documenting and conducting shareholder and director meetings.
